RE:  Moving Forward Toward the 2011 Ballot

 

Greetings,

 

We just celebrated America’s birthday and the peoples’ historical victory for freedom from British tyranny.  Now, 234 years later, we find ourselves facing new tyrants of our own making.  Yes, the people celebrate freedom, but they fail to recognize our impending dangers.  We must be vigilant in holding our government officials accountable to our state and federal Constitutions, for these are the compacts upon which our great federalist system was founded and government depends for all its political powers and authorities.

 

PCCOH has been working diligently to resolve our political challenges in an effort to restore constitutional government, both on the state and federal levels.  It was our hope that we could succeed in getting our proposed OHIO SOVEREIGNTY AMENDMENT on the ballot this November (2010), but it will not happen.  We believe this is a good thing, because the time is not yet at hand.  Our ultimate objective is not to get the amendment on the ballot, rather it is to get the amendment ratified by the people into law.  Going to the poles too early, before the people have been properly prepared, would be a tragic waste of effort.  Our goal is to win, and to win, we must be prepared.  And, to win at the poles, the people must be properly educated in the benefits of the OHIO SOVEREIGNTY AMENDMENT and why it is so important for helping to restore constitutional government.

 

To date, we have only just begun to collect signatures on our petitions.  This effort must be accelerated if we are to succeed in getting the amendment on the November 2011 ballot.  But, getting it on the ballot with 700,000 signatures is the easy part.  The greater calling is in educating the people sufficiently in their understanding of how our system of government is supposed to work that they will not be easily swayed by the opposition when it comes time to cast their votes.  Our objective is the help educate 3,000,000 Ohioans over the next 12 months.  PCCOH is now working on plans to put this challenge into action.

 

From the very beginning, we knew that our only chance of success would come from uniting Ohioans with a patriot spirit and getting them acquainted with the principles of government as set up by our founding fathers.  Over the past 150 years, our government has continued to erode away from those fundamental principles that made America great and protected the individual rights of the people.  It has always been the duty of the people to hold government accountable to the Constitution, and now is the time for us to exercise our sovereign powers over government to put it into proper realignment.

 

Over the next few weeks, we will be launching various programs to help facilitate our cause.  Some of these include:

 

·         A more aggressive leadership recruiting program

·         Establishment of dedicated PCCOH Groups throughout Ohio

·         Building of communications networking with various media outlets

·         Regularly scheduled training seminars

·         Further development of our website with administrative functions

·         And more

 

We at PCCOH believe that there are many patriotic Ohioans.  We want to convert these people from mere patriotic Citizens to full-fledged Patriots, those who stand up and take action and defend our freedom and don’t merely talk about it.  We want to help organize those who want real SOLUTIONS and aren’t looking for resolve only symptoms of the problem.  We are not going to talk about problems, anymore.  We are going to focus solely on solutions, and we think that is what you want, too.

 

PCCOH has been very impressed with the activities of the various TEA Parties and 912 Groups in support of the Ohio Healthcare Freedom Amendment.  For those involved in that effort, you are to be commended for your efforts.  But, there is much more to do and a bigger problem to solve.  PCCOH is the ONLY group who is offering a real solution for TAKING BACK AMERICA.  For those who feel up to this challenge and want to see real positive change, then we invite you to get onboard with our program and help us take America back from those who have been running our country into the dirt.  We need real LEADERS!  We need volunteers who will work to defend our freedoms.  We need sponsors to help with the costs of spreading this important message all across Ohio.  We need real Patriots, not pretenders.  While some are out to win their battle, we are out to win the war.  It’s time to get busy.

 

Are you up to it!  Can you dedicate a year of your life to help us restore the principles of good government!  Are you ready, willing, and able to defend American liberty against an enemy that is aggressively moving to destroy that liberty!  Are you willing to stand with the brave and honorable few who will dedicate their Lives, Fortunes and Sacred Honor to save the greatest system of government ever devised by man!  Understand we WILL all fight, none will escape.  WE choose to fight, now, while we have the ability to do so, peaceably.

 

Once you understand that saving America will save your liberties, and you decide that you are ready to take action, then contact us to find out what you can do to help.  This is a contact sport – no spectators allowed.  If I sound a wee bit harsh, it is only because America is about to crash, and it is time for you and me to take corrective action.  Get engaged!

RE:  Acknowledge, Identify, Decide, Commit, Succeed

 

Greetings,

 

This message is somewhat lengthy, but I feel it is important to help people decide and commit to this important cause.

 

Some of you may be familiar with ads on TV for exercise and fitness.  I am going to steal Tony Horton’s (P90X Program) slogan for our purposes, because many of us have difficulty getting started.  His slogan is “Decide. Commit. Succeed”.  This is very fitting for our purposes.  Of course, there are two elements missing – the first two elements, “Acknowledge. Identify”.  Let’s apply these to the OHIO SOVEREIGNTY AMENDMENT cause.

 

ACKNOWLEDGE – At this stage, a person notices a problem and acknowledges that something must be done about it.  In Tony’s program, it is already presumed that you have acknowledged that you are out of shape and identified his program as the solution.  However, this is not the case for most Americans who are still trying to come to grips with the reality of our problems with government.  Actually, the problems aren’t with government, but with those in government who are running government into the dirt.

 

So, let’s first acknowledge that there is a problem.  How do we know there is a problem?  Well, we observe the symptoms, like: 1) high taxation; 2) high unemployment; 3) large presence of foreigners; 4) continuous wars; 5) over-bearing and violent police interaction; 6) you can’t pay your bills; 7) you have to have government permission to do things that were taken for granted when you were a kid; 8) increase in criminal convictions; 9) more and more abortions; 10) corruption and abuse in schools; 11) you can’t pray when and where you want; 12) expressing your thoughts becomes a crime; 13) churches must be careful what they preach; 14) government control over health care, medicine, and natural supplements; 15) catastrophes that receive delayed attention from government; 16) states who are in bankruptcy; 17) government making more and more deals with foreign nations that take away our rights; 18) kids graduating from school barely able to read and write and who have absolutely no comprehension how our government works; 19) general lack of respect, discipline, and motivation in young people; 20) politicians who blatantly refuse to listen to their constituents; and much more.

 

By recognizing that certain things just don’t add up, we start to acknowledge that something is not normal or right, and we start to notice some problems at home or with people we know.  In conversations, people are complaining more.  People seem generally upset and frustrated.  These are all symptoms that there is a problem.

 

IDENTIFY – Once we realize that a problem exists, we then must identify the cause, if we are going to fix it.  Unfortunately, most people look at various “issues” and believe those issues are the problem, such as abortion, corruption in government, health care, social security, immigration, taxes, and so forth.  These are NOT the problem, rather they are “symptoms” of the problem.  If all we ever do is focus on issues (symptoms), then the problem never gets solved and new issues will arise.  Let’s use the current gulf spill as an example.  You go out into the gulf and see oil floating in the water, and you say to yourself, “This is a problem”.  Then you say, “Why isn’t someone cleaning this up?”  Cleaning up the problem is an “issue”.  To solve the problem and prevent additional oil from emerging requires that we shut off the cause of the problem by plugging the hole from where the oil is leaking.  Of course, yet the bigger solution would be preventing it from ever happening again.

 

With today’s political environment, many people are recognizing problems.  And their first reaction is to start in on the various issues.  Because of their lack of understanding, they fail to recognize the fundamental cause for the problems.  Here it is – I’m going to tell you what the fundamental cause of all our governmental problems is.  It is “lack of control”.  Of course this needs a bit more definition for people to understand.

 

Our American system of government was designed to maintain strict control over government and its activities.  However, without someone holding those in government accountable to their limited duties, government has run astray, and those in government have abused and misused their governmental powers and authorities.  The result is the destruction of our system of government, stealing of the American peoples’ wealth, creation of a perpetual enslavement to debt, expansion of government authority around the world by military force, and destruction of the peoples’ individual Rights and Liberties and inability for us to provide for our futures.  The perpetrators are nothing less than criminals who have, through the manipulation of law, stolen our American and Christian heritages and are replacing them with complete tyrannical domination.  People who do not acknowledge this are either absolutely blind, so self-indulgent that they are oblivious to the corruption, or they are part of the problem.

 

The “solution” is to regain control over government.  Fighting individual issues will not solve the fundamental cause of our problems.  At most, it will only offer temporary relief for some, but bigger issues will emerge.  To regain control over government, the people of America must unite in purpose and take appropriate action to restrain government.  There are only two ways to do it: 1) by force of law; and 2) by force of arms.  It is our duty to exhaust all our peaceful solutions before using arms.  Our system is one of law, and the highest law is the Constitutions.  We have two – state and federal.  The state Constitution takes precedence over all domestic matters, and the federal Constitution takes precedence over all interstate and international matters.  The powers and authorities granted by the people through these Constitutions are limited and specific.  To regain control, we MUST get government back into proper alignment with the Constitutions, AND we must create provisions within the Constitutions that provide the people an effective and efficient means for holding government accountable to them.  NOTHING SHORT OF THIS SOLUTION WILL SUFFICE!

 

DECIDE – Restoring constitutional government is, of course, a bigger battle than opting out of government health care.  However, the process is exactly the same.  One of the biggest challenges for success is convincing the people that IT CAN BE DONE!  Most of us have lived all our lives in fear of government, being convinced that “you cannot fight city hall”.  This is absolutely FALSE!  Public officials work for the people.  The people tell government what it can and cannot do.  Government serves the people, not the other way around.

 

PCCOH has devised a plan for taking back America that WILL WORK!  But, we cannot do it alone.  We MUST have the support of the people to get the job done.  Once the people understand that it CAN BE DONE, then all that is left is for them to DECIDE TO DO IT!  Some fall short from fear of what freedom will cost them, so let me clear this matter up for everyone.  Here are the trade-offs.  Preserving and protecting your freedom will cost your “LIVES, FORTUNES, and SACRED HONOR”.  However, the price of refusing to fight for your freedoms will cost you the same things, your “LIVES, FORTUNES, and SACRED HONOR”.

 

The difference between fighting and not fighting for our freedoms is the end result.  Fighting results in FREEDOM and the ability to PROSPER, while refusing to fight results in ENSLAVEMENT and having NO PROPERTY OR WEALTH.  Fighting requires you to spend your time collecting signatures, going to meetings, helping others, spreading the cause, and be a person of honor and integrity.  Not fighting means you can be quiet, sit on your butt, watch TV, go bowling, remain ignorant, and be a person who is self-centered and dependent on government hand-outs.

 

I cannot decide for you, but I will not fight for you, either.  I fight for those of like mind and purpose – those who have the courage to defend what is right simply because it is the right thing to do.  Those who believe that to live in freedom is more important than making a paycheck, watching football, or lying on the beach.

 

So, decide!  And once you decide, then either get on with it and get it done, or get out of the way of those who will.  No excuses.  If you get stuck, then team up with others who are headed in the right direction.  Work together to achieve more.

 

COMMIT – Deciding to defend freedom is much like deciding to start a fitness program.  You know it needs done, and it is going to be inconvenient and painful.  Every man and woman must decide in their own mind their purpose for joining the battle.  Your purpose MUST be bigger than you.  What I mean is that the purpose must be something so important and powerful that you would be willing to do almost anything to achieve it.  Whether your purpose is to benefit your family, community or country, only you can decide.  But, once you do decide, then you must COMMIT!  To commit means that you find your inner-strength to do things you have never done before, to face your fears, and to do it even when no one else is around.  It becomes your personal battle.  Your commit is such that you will achieve it alone, if necessary.  You understand that maybe you cannot do everything, but you know there are things you can do to perpetuate and support the cause.  You do not hesitate or shirk your responsibility.  You do what you can when you can, and when you can’t, you find others to take your place or help.

 

Commitment is the most important element for success.  It requires perseverance and action.  Commitment is the one attribute that defines who you are as a person, for it is directly linked with your character.  For those who truly commit, then failure is not an option.

 

SUCCEED – When you have acknowledged a problem, properly identified the cause, decided to resolve the problem through proper planning and action, and committed to resolving it at all costs, then nothing but success can result.  But, know what success looks like by establishing your objective and recognizing it when you arrive.  An undefined objective leads to confusion and meandering.  Always keep in mind the reward for success.  And, when success comes, know that you did your best and are among the elite who deserve the rewards of your efforts.

 

Here’s the bottom line in regard to this message:  Government is operating well outside its constitutional authorities, and PCCOH has devised a solution for restoring constitutional government.  We need your help.  The results of this effort would be the ability of the people to hold government accountable to our state and federal Constitutions, by law.  Failure cannot be an option.  We are the only organization in the entire country who is offering a solution such as this.  Please make your decision whether this cause is something you can support.  And when you decide, then make your commitment, accordingly.

RE:  Concerns about the Proposed Recall Process

 

Greetings,

 

There appears to be some concern over the “Recall” process in our proposed OHIO SOVEREIGNTY AMENDMENT.  Though the statements we received are a bit off point, I will address the issue to help clarify it.

 

QUESTION/COMMENT:

 

(1)          Can ACORN or MOVEON.ORG use paid petitioners to remove a public officeholder from office?

 

ANSWER:

No.  The OHIO SOVEREIGNTY AMENDMENT is about the individual sovereignty of the people and state sovereignty.  ACORN and MOVEON.ORG do not qualify as “the people”.  The matter of sovereignty, in particular that related to the Recall process, is not an attribute belonging to corporate or bureaucratic entities.  The Recall process belongs solely to the people as a means for controlling government by removing those deemed by the people to be abusive, negligent or otherwise incompetent to serve or satisfy the publics’ interests.  If the people decide that they are dissatisfied with a public officeholder, for whatever reason, they should be allowed to remove (fire) that person and replace them with someone they deem more appropriate.  The process, itself, requires the Citizens of the relevant district to vote by petition for the Recall, and if enough people deem the action appropriate, then they shall have the power to execute it.  The purpose of this process is to provide the people better control over their government and ensure that those they elect into office fulfill their duties to the public with integrity.

 

QUESTION/COMMENT:

 

(2)          Why does the Recall process bar the relevant public officeholder from future office and benefits?

 

ANSWER:

We believe that our state and federal Constitutions are the most important documents to our American system of government.  Yet, we are aware that the majority of those we elect to serve the people and uphold the Constitutions pay little attention or respect to those instruments.  This is absolutely wrong!  Public officeholders have but one primary duty, and that is to serve their constituents in compliance with the Constitutions.  When a public officeholder abuses or misuses his office, neglects his constituents, is incompetent or negligent in his duties, then the people have the right to remove him and replace him with someone else they deem more qualified for the office.

 

Now, when a Recall has been conducted, it is the duty of the people from the relevant district to nominate new candidates they like.  Then, the Governor would review the qualifications of those nominated candidates and appoint one to fill the remainder of the relevant term.  The nomination qualifications would be established in law and require a significant threshold so as to determine those candidates most favored by the people.

 

Regarding the matter of future service and benefits – we agree that the proposed Recall process provides harsh consequences against those who are Recalled or otherwise removed by force or compelled from office.  The point to be made is that the people should not have to tolerate those who they deem inappropriate for public office nor continue to pay them for their unsatisfactory behavior.  It has been postulated that the people could Recall a public officeholder who has committed no wrong.  Hypothetically, I suppose this could happen, but I believe that it would be unlikely.  When someone performs with integrity on behalf of the people, the people will naturally want to keep that person in office, because he is doing the job the people elected him to do.  And, since the Recall process is solely a right of the people, there should be no corporate or other form of interference form private interest groups for their own agendas.  The Recall process is executed by petition, vote as opposed to a vote at the polls, to allow for more immediate results and save money.  All petition signatures must be properly verified and authenticated by the Ohio Secretary of State.

 

This process serves as an aggressive incentive for public officeholders to perform their public duties with honor and integrity, realizing the consequences of unsatisfactory behavior.  Yes, the consequences to a Recalled public officeholder are severe, but the people demand strict compliance and accountability of government.  And due to our current circumstances, the need for such strict mandates is warranted.

RE:  PCCOH Response to Dispatch Letter to Editor, “Do we really want another civil war?”

The PEOPLES CONSTITUTION COALITION OF OHIO (PCCOH) knew when we began our project to restore constitutional government that our biggest challenge would be to overcome the misperceptions and misunderstandings of the general public.  The short letter to the editor titled “Do we really want another civil war?” posted on May 27, 2010 is a good demonstration of the peoples’ ignorance of our American history and system of government.  I do not say this in disrespect nor to be condescending, rather to illustrate that the American people have lost their true connection and identify with our American system of government.

 

For example, when the southern states exercised their right to secede from the Union in 1860, their motivation was not to nullify the U.S. Constitution – it was to oppose the federal government’s usurpation of states’ rights.  What I mean is that, it was not the states that created the problem.  It was the federal government over-stepping its constitutional authority over the states that caused the states to rebel.  When the U.S. Constitution was ratified by the various state legislatures, it was on the condition that the federal government would operate within its narrow limits of authorities as enumerated at Section 8 of Article I of the Constitution.  This is clearly evident in the session writings of the debates during the ratification hearings.

 

The said letter goes on the label PCCOH, proclaim that we are “anti-government”, and falsely proclaim that our proposed OHIO SOVEREIGNTY AMENDMENT would “nullify our Constitution and federal laws”.  It is quite obvious that the writer has not read the proposed amendment or our website.  PCCOH is a non-partisan, non-denominational grassroots association of average people from the community who have come together in an effort to restore constitutional government.  We are NOT anti-government.  Our objective is the get government to adhere to the Constitution.  And, the proposed amendment does not nullify the U.S. Constitution or federal laws enacted in compliance with it.  If fact, Section 2(B) of the proposed amendment clearly recognizes the supremacy of the federal Constitution.

 

We at PCCOH do encourage smaller government.  America was established as a Union of states comprised of people who were hard-working, motivated, self-reliant, and shared a strong moral belief.  They were not people who relied on government to take care of them.  Our society is one built on the individual strengths of the people, not governmental hand-outs or principles of socialism or communism.  America is the land of the free and home of the brave, right?

 

The said letter attempts to arouse the people of the community with false accusations of civil war and other bloody encounters.  This is certainly not the case with the proposed OHIO SOVEREIGNTY AMENDMENT.  Though the amendment is an aggressive solution to meet these critical times, we have always proclaimed that it offers a “peaceful” solution to our problems.  The federal government is moving very quickly to defeat our freedoms and liberties.  It has always been the duty of the people to hold government accountable to the Constitution.  We have failed in that duty.  PCCOH has constructed a solution to hold government in compliance with and accountable to our state and federal Constitutions, and the OHIO SOVEREIGNTY AMENDMENT provides the legal mechanisms for the people to be able to fulfill this duty.

 

We ask the people of Ohio to make a clear assessment of our current situations with the economy, immigration, war, foreclosures, Social Security, Medicare, health care, and on and on.  Our system is failing, and all government can do is rob the people with stimulus money to pay off the large corporations and protect their investors, while the people, generally, suffer from our loss of our industrial base and have to resort to buying foreign-made products.

Do we really want another civil war?

About 150 years ago, several states began taking action to nullify the U.S. Constitution; this action led to the bloodiest war in our nation's history.

Now a group of right-wing conservatives, hoping to get an enthusiastic anti-government vote in the 2010 election, proposes the Ohio Sovereignty Amendment, which would nullify our Constitution and federal laws ( Dispatch article, May 14).

The group behind this effort calls itself the Peoples Constitution Coalition of Ohio. I wonder where the group gets its funding.

It demands a smaller government but does not have the courage to identify the programs it would eliminate. If you are approached by somebody and asked to sign a petition to put this “sovereignty” issue on the ballot, ask yourself and the person with the petition to explain why the Civil War should be fought again. Also, try to think, “What would Abraham Lincoln do?”

Greetings,

 

I would like to encourage every one of our volunteers to help coordinate state-wide town hall meetings in every county on Saturday, May 29, and Saturday, June 5 from 1 PM until 4 PM.  Our purpose is to bring people from the community out to here about the proposed OHIO SOVEREIGNTY AMENDMENT and sign the petition.  We also need to use this opportunity to recruit TEAM LEADERS to organize community groups to go door-to-door collecting signatures.  PCCOH can send out a state-wide public announcement to all newspapers and radio stations in our database to help make the announcement.  However, we believe it important for you to make personal contact with your local news media, also.

 

What we propose is that you conduct the meetings outside, if possible, at a park where distractions will be minimized.  Have people bring their own lawn chairs and non-alcoholic beverages, as appropriate.  Print out as many bi-fold flyers you think will accommodate your crowd so everyone who attends can have one to take home with them.  If you want to offer hotdogs and other food items, feel free to do so in accordance with local regulations.

 

Now, for those interested in going door-to-door, you can download the voter registration lists from the Ohio Secretary of State’s website by following these instructions:

 

(1)          Go to http://www2.sos.state.oh.us/cf_ftp/voter_ftp_home?agree_flag=Y to access list;

(2)          Find the county you are interested in and “download” the appropriate file to your computer;

(3)          In your Windows Explorer window, go to “Tools”, “Folder Options…”, “View” and deselect “Hide extensions for know file types”;

(4)          Go to the downloaded file on your computer and rename the file with a .CSV file extension instead of .TXT;

(5)          Double click on the file name, and it will open up a spreadsheet containing all the registered voters in the said county.

 

I did this for Knox County, and it works.  This wonderful information comes to us from Joeseph Mitsch of Crawford County.  If you have any problems downloading and accessing these files, let me know.

 

We must get aggressive at collecting signatures.  I don’t mean aggressive toward potential voters.  I mean we need to get after it right now and get it done – no delays, no excuses.  Spread the word to everyone, but be polite, friendly and pleasant.  Answer their questions if you feel you are knowledgeable enough to do so, accurately.  Otherwise, have them contact us or go to our website for answers to their questions.  If done in the right spirit, these events should be fun, informative and a great opportunity to build alliances.  If we fail to get all the signatures necessary to qualify for this November’s ballot, we will have to wait until at least next November before we can get on the ballot.  As long as we keep hold of our signatures, they will still be valid.

 

I have been talking with many people in the media and from around the state this past week.  Interest is building.  Some have contacted me from out of state, so we know the message is starting to get around.  You are doing a great job.  Keep it up.

 

PCCOH would like you to be aware of this – getting signatures is the easy part.  The bigger challenge is to adequately educate the people well enough with such understanding and conviction that, when the opposition begins, they will not sway and will hold fast to this cause.  And, we believe opposition will eventually come, with big money behind it.  We must form a strong and lasting bond with our communities and friends so that when the time comes to vote, the people will vote in favor of the OHIO SOVEREIGNTY AMENDMENT and ratify it.  Freedom is not cheap and it is not always easy, but it is always worth the price.

 

When Patrick Henry recited those words, “Give me liberty or give me death!”, he was willing to give his life in pursuit of freedom.  When our soldiers go to war, they too put their lives on the line, and they do it in the name of freedom.  What are YOU willing to do for freedom?  PCCOH has designed a real solution whereby the people of Ohio will have the legal mechanisms to protect our freedoms from abusive government, better than any other state has.  We are leading the way to take back America and expel governmental usurpation and corruption.  We need every man and woman standing in support of this great cause.  And, we at PCCOH are proud to be standing with you.

Today is the day.  The certified OHIO SOVEREIGNTY AMENDMENT petition is ready for collection of signatures from Ohio voters.  (See attachment)

 

As we begin this extraordinary journey to restore constitutional government, let us all remember the importance of this task.  There will be opposition from those who either have an agenda contrary to our constitutional system of government, oppose the responsibility that individual freedom demands, prefer a socialist agenda, or are completely ignorant of the matter, generally.  We cannot let our opponents distract us from our goal or deceive us into believing that this effort will have no significant importance.  While we have the ability and opportunity to peacefully resist tyranny, we must grab hold of it and use it to our fullest advantage.

 

As we have said before, time is short.  To succeed in getting this amendment on the November ballot, we MUST have all 700,000 signatures cataloged and submitted no later than June 29th.  In order to have time to organize all the petitions we receive, we are requesting all petitions be submitted to us no later than June 20th.  The instruction page to the petition has changed, so please read and understand the new instructions.  If you have questions, then please ask before you start collecting signatures.  We will try to get something on the website to help answer questions about the petition, so keep checking.  If and when we do, I will make an announcement.

 

As you get petition packets completed with 100 signatures, go ahead and send them in so we can get started cataloging them as soon as possible.  Also, as you collect signatures on the petition, ask people to volunteer and help collect signatures.  We still need many County Coordinators.  If you can help in this regard, let us know.

 

We are here to help.  We need your devoted help for as long as it takes to get the required number of signatures and this amendment ratified into law.  I have also attached the listing of signatures required for each county.  We will keep you advised of our progress as we receive petitions.  In order to satisfy the requirements, we must have at least 44 counties qualified.

On Friday, May 14th, PCCOH sent out a state-wide PRESS RELEASE to over 200 newspapers and radio stations announcing certification of the OHIO SOVEREIGNTY AMENDMENT.  I am asking folks throughout Ohio to check your newspapers and let us know if anything appears in your local paper about PCCOH or the OHIO SOVEREIGNTY AMENDMENT.  If possible, please scan the article and newspaper header and send it to us for our records so that we can determine where the message is receiving public support.

 

Our email and phone activity has already increased, and we expect everything to move very quickly.  30 days folks!  If everyone can get busy and dedicate themselves to this effort for 30 days, we will succeed on getting this on the November ballot.  Print off some flyers from the website and pass them around.  As soon as we receive the certification letter from the Attorney General’s office, in hand, then I will put the finishing touches on the petition and notify everyone that we are ready to start collecting signatures.

RE:   Ohio Ballot Board Approves OHIO SOVEREIGNTY AMENDMENT

 

Greetings,

 

PCCOH went before the Ohio Ballot Board, today, and obtained approval for the OHIO SOVEREIGNTY AMENDMENT.  The board must now notify the Attorney General’s office, who will then notify PCCOH of our official certification of the amendment.

 

         We are now preparing for our official signature collection campaign.  We cannot start until the official certification has been received, which should be within the next few days.  In the mean time, we will make the necessary adjustments to the petition and get it posted on our website for people to download.  In addition, we are adding our bi-fold flyer to the website so you can print and pass them around to people you come in contact with.  But, please don’t start collecting signatures until we give you the word to do so.

 

         For now, what we all can do is spread the word and start lining up all our help and make arrangements to collect signatures.  Also, we can work on establishing Sovereignty Stations around the state.  There is little time, about 40 days to collect roughly 700,000 signatures.  Attached is a file containing a list of minimum the number of signatures we need for each county.  Now is the time for people to step up as leaders in your counties.  Several can work together, if necessary.  But, we must get busy.

 

         We at PCCOH will try to put together some additional information to help you complete your mission.  Please monitor the website often for new information.  Check the “CURRENT EVENTS: PCCOH News” section of the website to keep up to date with the latest information.

RE:   Certification of OHIO SOVEREIGNTY AMENDMENT

 

Greetings,

 

Today is a good day, indeed.  We initially launched our petition for the proposed OHIO SOVEREIGNTY AMENDMENT at the TEA Party Rally in Columbus, Ohio on August 1, 2009 - nine months, ago.  I am happy to say that, after our 4th submittal, we have finally acquired approval from the Ohio Attorney General, Richard Cordray, so that our petition can be certified.

 

To complete the certification process, the proposal must go before the Ohio Ballot Board, of which Ohio Secretary of State, Jennifer Brunner, is the chairperson.  The Ballot Board must review the proposed amendment to make sure it complies with Ohio law regarding proper process.  This includes ensuring that the proposed amendment satisfies the “single-subject” rule as specified at R.C. 3505.062.

 

In anticipation of this challenge, we have taken the following steps:

 

(1) The last revision of the proposed OHIO SOVEREIGNTY AMENDMENT was restructured specifically to address this issue by reorganizing the amendment and titling each provision in support of the single-subject, “SOVEREIGNTY: Duties, Powers and Authorities; Compliance and Accountability”;

 

(2) PCCOH conducted research for supporting case-law at the Ohio Supreme Court Law Library to specifically address the “single-subject” rule specifications; and

 

(3) PCCOH has acquired the support of Senator Grendell, who is also an attorney, to represent PCCOH in the Supreme Court of Ohio should it become necessary to challenge an unfavorable decision from the Ohio Ballot Board.

 

We are very confident that the proposed amendment “should” pass through the Ohio Ballot Board, successfully.  But if it doesn’t, we are confident that we can defend our position successfully in the courts.

 

As always, the Committee is thankful to all the dedicated volunteers who have selflessly contributed their time and resources in support of this important cause.  But, the battle is far from over.  We MUST recruit more volunteers who are willing to defend our freedoms and support this amendment that will give us the tools we need to hold government in compliance with and accountable to our state and federal Constitutions.

 

Please, please, please — continue to spread the message, and volunteer to do your part.  We ALL need this amendment in order to protect us from further encroachments upon our Rights and Liberties.  We will not quit.

RE:  Saving America

 

Dear Gary,

 

I am writing to you in response to the article “Saving America from Corporate-Statism”, by Nelson Hultberg, which appeared on your WHISKEY AND GUNPOWDER website on April 23, 2010.  I agree that a solution to the political scheme must be promoted and we must sever the corruptive influences of wallstreet over government.  However, these are both symptoms of a deeper and more fundamental problem.

 

The take-over of The United States of America has been evolving since before the establishment of our federal Constitution.  There is no perfect government.  All become corrupt over time.  There is only one way to eliminate this from happening.  From the beginning of the Union, it has been the duty of the people to hold government accountable, but there is a problem.

 

As we speak to the people throughout Ohio (and some other states), they are amazed to discover that the most fundamental mechanisms of protecting our system of government are absent from our state and federal Constitutions.  And, what few protections were put in the Constitutions, have been manipulated and perverted or amended by government to eliminate these protections.

 

The problem with the TEA Parties, the 912 groups, and articles like Mr. Hultberg’s, is that they only address the first three steps of a 5-step comprehensive solution.  Without the last two steps to complete the solution, the system (government) never reaches any state of equilibrium and sustainability.

 

The “key” to maintaining integrity in government is ACCOUNTABILITY!  There are only three ways to hold government in compliance, one by free-will and two by force:

 

(a)          By one’s moral compass or conscience (usually achieved through either love of thy neighbor or fear from the wrath of God);

(b)          By force of law; or

(c)          By force of arms.

 

At PCCOH, though we promote a moral standard that harmonizes with God’s law, we cannot rely upon this, solely, to hold those in government in compliance with our fundamental standards as a nation.  However, this is how the Union was established, and John Adams (founding father) knew that if the people of the nation and their leaders, ever became corrupt, that the Constitution would be completely inadequate to protect the Rights and Liberties of the people and prevent despotism from over-shadowing our freedom.  He expressed these sentiments in his comment, “Our Constitution was made only for a moral and religious people. It is wholly inadequate to the government of any other.”  The people have ceased to be virtuous and religious, and our leaders have removed God from government.  We are desperately in need of a revival, and new checks and balances upon government must be established.

 

People are surprised to learn that neither our state nor federal Constitutions mandate, BY LAW, that government comply with the Constitutions or ensure that its laws are constitutionally compliant before enactment or enforcement upon the people.  It is “assumed” that these criteria are inherent within the meaning and intent of the Constitution.  And, they were, but government, over time, has expanded the meaning of the Constitution to encompass powers and authorities well outside its original intent, and the people are left without an effective or efficient means for holding government in its place.

 

Though we agree with all the ranting and raving going on about government corruption, it is time to implement a solution.  Mr. Hultberg, like everyone else, only talks about the problems, but offers no solution or plan for correcting the problem.  We have the solution.

 

Our solution is simple, but it will require the people of America to get out of their chairs and take an active part.  Attached, you will find a petition.  It is not your ordinary petition that lacks legal force, as so many are.  This is a petition to introduce an amendment to our state (Ohio) Constitution.  It is being implemented through the peoples’ initiative process.  Our objective is to get this amendment on the ballot for the people to ratify it into constitutional law, in Ohio.

 

Here is the plan.

 

State and federal government are corrupt.  The people have no direct ability to hold the federal government accountable to the Constitution, but the states do.  The people do have direct influence over their states.  The plan is to fix state government, first, and then mandate that the state protect its people from all unconstitutional encroachments by the federal government.  To do this, we are proposing the following:

 

(1)          Strict mandates that require government to adhere to the Constitution;

(2)          Penalties against any public servants who violate the Constitution; and

(3)          Provisions (the legal tools and mechanisms) that provide the people with an effective and efficient means to directly hold government accountable to the Constitution.

 

This plan does not require public servants to possess a moral conscience.  But, it does require them to obey the law of the Constitution, under threat of pains and penalties.  I invite you to review the attached petition and submit to us your comments.  We plan to initiate this plan throughout all 50 states.  To do so effectively, we will need all the help we can get.  We will need everyone to get on board with the program and promote it far and wide.

 

The reason I am taking the time to contact you is because I agree that America needs saving.  The said article, like so many others, provides no solution, only symptoms.  If we are to save America, then we must take action, and that action must be by force.  Our approach uses the force of law.  Though it is a peaceful solution, it is very aggressive.  Opposition will be great.  But, it must be done, or we will lose our freedoms, permanently.

 

If this project is something you can support, then I invite you to contact me, and we will include your organization in our partner groups.  I look forward to your response.  Together, we CAN take back America, and we CAN restore our federalist republic, and we CAN restore our Christian heritage.

 

Oh, by the way, the steps to a complete solution are: (1) Education and awareness; (2) Eviction of corrupt public servants; (3) Instatement of virtuous public servants; (4) Amendment to the law to mandate governmental compliance and accountability; and (5) Enforcement.

RE:   Petition Modification – Font Size

 

Greetings,

 

This is a note to let everyone know that a slight change was made to the petition form that is downloaded from our website.  The content and structure of the petition is exactly the same as before – there is no change that would invalidate any petition.  All I did was change the font size used in the SUMMARY and AMENDMENT to a 10 pt.

 

It had been recommended by the Ohio Attorney General’s office that the SUMMARY be short and concise, no more than two pages, if possible.  To satisfy this parameter, I reduced the font size to fit the SUMMARY onto two pages.  However, upon review of the Ohio Revised Code, it states that the SUMMARY is to be in a 10 pt. font.  I contacted the Attorney General’s office to determine which parameter was more important, because there is no way we can satisfy the page and font parameters and still provide an adequate description of the amendment.  It was decided that the font size is more important than the number of pages, provided the SUMMARY is substantially shorter than the amendment.  It is.

 

The reason I am notifying you of this minor change is so that you don’t become alarmed by the change in appearance of the petition.  If anyone brings it up, please explain as I have.  The change does not constitute a “material” change to the language of the amendment, and therefore does not void any petition signatures collected.

 

When printing new petitions, please use the attached file or download the petition from our website.

RE:   Amendment Update and More

The Committee worked very hard last week to update the OHIO SOVEREIGNTY AMENDMENT and SUMMARY to conform with the comments by the Ohio Attorney General, Richard Cordray.  Late Friday night, I put the last touches on the petition, and it was then released for collecting signatures.  Over the weekend, people got busy and collected approximately 850 signatures.  The record in one day and one event was set by Toledo District Leader, Jim Flaugher and his crew, at over 700 at the ResistNet Rally in Cleveland.  Currently, we are sitting at approximately 1,050 signatures.  We need a minimum of 1,600, and with everyone’s help, we should easily satisfy that number by the end of this week.

 

The current version of the OHIO SOVEREIGNTY AMENDMENT is the best it has ever been.  Because of confusion by some over the Peoples Constitution Council provision in the amendment, the Committee decided to remove that provision and pursue it at a later date.  Also, the new amendment has been reorganized and structured for easy readability.  Several provisions that were previously under a more generic title have been separated under their own title, such as the Government Transparency provision.  The amendment, summary, and petition are all available for your review on our website at www.pccoh.com under the “AMENDMENT” button.

 

Though we feel the amendment summary has been written to satisfy all of the Attorney General’s concerns and that it should pass his scrutiny, we will prepare for the worst.  In the event that the amendment is rejected, we will pursue a challenge in the Supreme Court of Ohio.  We have also been preparing in anticipation of the review by the Ohio Ballot Board.  Time will tell, but we will not give up.

 

Lancaster Regional Director, Kim Wilhelm, and Lima Regional Director, Nancy Wheeler, attended the Dayton Freedom Rally and Wright State University and collected signatures, distributed information and answered questions.  Tomorrow, Toledo District Leader, Jim Flaugher, and Committee Member, Curtis Olson, will be attending the Hope for America Rally in MansfieldKim Wilhelm will be at the Tax Day Rally in Zanesville, and Michael will be in Cleveland working with Cleveland District Leaders, Alan and Debbie Wilson, giving presentations at John Carroll University and the Cleveland TEA Party Rally.  Yes, we have been very busy, and we intent to keep busy.

 

If you take a look at our website, you will notice all these events listed on the right-hand side of the HOME page.  By scrolling the cursor over the event listing, a popup will appear of the event flyer, which can be printed out and distributed.  Also, a video of a live presentation by Michael while in Erie, Pennsylvania (about 30 min.) is available for viewing.  Just click the button on the left-hand side of the HOME page titled Abusive Government: The Solution, The Plan.

 

Dave, our faithful webmaster, has been working diligently to launch our new Sovereignty Station feature.  We expect to see this operational very shortly.

 

Kim Wilhelm has been promoted by the PCCOH Committee from Lancaster Regional Director to Columbus District Leader.  Kim had demonstrated extraordinary dedication and effort to our cause and deserves this honor.

 

IMPORTANT:  Due to our intense effort to get the new petition submitted to the Attorney General, please send all outstanding petition signatures to PCCOH at the address listed on the petition instruction page no later than this Monday (04/19/2010).

 

Also, we are planning a PCCOH Leadership and Volunteer Training Meeting on Sunday, May 2nd, in Mansfield.  Please reserve that date on your calendar to attend.  An announcement with specific details will be sent out within the next few days.

 

It is time to start forming our own PCCOH groups around the state.  We have plenty of people who have shown interest in this important cause to justify this course of action.  The Committee will be working on a strategy and formulate a plan to make this activity effective, rewarding, educational, and fun.  Stay tuned.  If you are interested in this, give us some feedback.  We also believe that there are many people who are becoming disenchanted with the TEA Party groups and 912 groups due to lack of a viable solution for holding government accountable to the Constitution.  We have the solution, the plan, and drive to get government back on track.

RE:   Results from Ohio Attorney General

On March 26, 2010 the Ohio Attorney General, Richard Cordray, rejected the SUMMARY for the proposed OHIO SOVEREIGNTY AMENDMENT on the basis that it was not a “fair and truthful statement” of the said amendment.  Mr. Cordray expounded upon his reasoning and revealed a few critical errors with the SUMMARY.  Our submittal and the Attorney General’s rejection letter can be reviewed on the Attorney General’s website at:  http://www.ohioattorneygeneral.gov/Legal/Ballot-Initiatives.

 

When we began this project, we understood that it would involve challenges, and there would be opposition.  We also understood the immense importance of this task to restore government to the Constitutions.  We understood it would involve learning how to work within the system to achieve our goals.  We understood that it would take sacrifice of our time, efforts and resources.  We understood that to achieve our objective, we would have to persevere and hold true to our course.  And, we understood that some would not be able to sustain the battle.  However, we resolved that we would not give up – we would do what was necessary to hold government accountable to its duty to the people.

 

Therefore, over the next week, we will review the SUMMARY and make such changes as necessary to satisfy the requirements set forth in the rejection letter, one more time.  We will ask that you resolve to stand fast to this cause and help us collect the necessary signatures.  We currently have over 300 people who have expressed their willingness to support this effort.  If each collects just 10 signatures, we would have more than enough to satisfy our next submittal.

 

But, that is not all.  We will begin to prepare the necessary filings to the Supreme Court should the Attorney General refuse to certify the next submittal.  We have worked diligently to have our voices heard, and we will continue to do so.  In about a week from now, we will call a meeting of the top PCCOH Leaders to review the new SUMMARY and enter their comments and suggestions.  Those people will be notified by me of the time and place of such meeting.  Our final submittal will be prepared, signatures will be collected, and we will once again seek certification of the proposed amendment.

 

Now, we have witnessed extraordinary support for the health care amendment.  Of course, the health care “issue” is the hottest issue in the country, at this moment.  However, it does not address the core problem.  Until we succeed in holding government in strict compliance with the Constitutions, government will continue to encroach upon our Rights and Liberties.  The key, folks, is the proposed sovereignty amendment.  It is the only solution being proposed that is designed to hold government in compliance with the Constitutions.  Understand, when we succeed with this amendment, most of the encroachments by government will be eliminated.  We need the kind of support demonstrated for the health care issue.  Time is running out.  We are P minus 80 days when we need to have our qualification signatures ready for November’s ballot.  We still have time, but we need to get busy and work quickly.  We also need more volunteers.  It is time to start recruiting heavily to get people on board to get the job done.  We know we can do it.

 

We are truly thankful for the efforts put forth thus far.  We have until June 20th to satisfy the November ballot deadline.  Please stand with us in this important fight.
